More on Cohen and Cook

Professor Lawrence Solum offers a detailed analysis of one of the cases referenced by Cohen in his column today attacking 6th Circuit nominee Deborah Cook. His conclusion regarding the case is worth quoting at length, particularly given his statement that he is not necessarily a proponent of Bush’s judicial nominees, and his further concession that he did not know much about Justice Cook’s record:

An assessment of Justice Cook’s performance in Wal-Mart should not be based on the question whether she favored the little guy or the big corporation. It should be based on the quality of her reasoning. Her opinion should damn her if it shows she lacks judicial integrity, fidelity to the law and concern for its coherence. But her opinion in Wal-Mart simply does not show those things.
