Deborah O'Malley is my new favorite commentator.
To quell my fears of an Obama executive and Democratic control of the legislative branch, I have been focusing on a balanced judicial branch to save us from excess. However, my comfort was short-lived when I recalled a discussion with Professor Jean Edward Smith regarding the courts. To balance, what he thought was an overly conservative court, he proposed increasing the number of justices. With control of the house and senate, and the prospect of super majorities, this is a real possibility, is it not? Might we have another court packing scheme on our hands?
