Breaking news from Fox:
LINCOLN, Neb.— A federal judge blocked implementation of a federal ban on partial-birth abortions Wednesday less than an hour after President Bush signed the ban into law.
U.S. District Judge Richard Kopf (search) issued a temporary restraining order citing concerns that the law did not contain an exception for preserserving the health of the woman seeking the abortion.

Not surprising because Leroy Carhart, an Omaha area OB/GYN abortionist vowed to go after the PBA statute. He is the Carhart of Stenberg v. Carhart, the US Supreme Court case dealing with Nebraskas failed attempt at banning PBAs.
The Omaha World Herald article states that Judge Kopf stopped short of prohibiting the new law from being enforced nationwide. Kopf said his order would apply only to the four doctors who filed the lawsuit in Nebraska.
